Initial Claims: Damages related to shipping must be reported within 24 hours of delivery.  Quality or shortage claims must be reported within 5 working days of delivery.  A report detailing the issue along with digital photos must be submitted.  Claims involving virus, disease, or plant performancee, require customer to send a sample in it's growing container to a professional lab or to Pell Greenhouse for testing.  Tests must include PG and soluble salts.  If sample is sent to a lab, the lab report must accompany the claim.

Final Claims: After initial claim is made according to the above guidelines, it is the Broker's responsibility to provide Pell Greenhouse with "Final Numbers" within 30 days of customer receiving order.  Any claim not received within 30 days will be denied.

**FAILURE TO NOTIFY PELL GREENHOUSE OF CLAIMS WITHIN THE ABOVE TIME FRAME WILL RESULT IN AN AUTOMATIC DENIAL OF CLAIM.**

Sales Conditions: Pell Greenhouse, Inc. warrants only that the plants we sell conform to the label descriptions as required by all applicable State & Federal laws.  We make no other warranties, express or implied, of merchantability, fitness for any particular purpose or otherwise.  Our liability for the breach of any warranty or contract with the respect to such plant material or replacement thereof, is at our discretion.  These warranties and limitations of liability of Pell Greenhouses Inc., may not be altered or amended except by an instrument in writing signed by Pell Greenhouses, Inc.  By acceptance of the plant material, the buyer acknowledges the limitations and disclaimers herein are conditions of sale and they constitute the entire agreement between the parties regarding warranty and other liability.

Pell Greenhouse does not offer a guaranteed program and are not responsible for issues beyond our control such as flowering time, customer crop times, or customer losses.
